Overview

Divorce in Thailand can be pursued through two main pathways: uncontested divorce (by mutual agreement) or contested divorce (through court proceedings). The type of divorce you pursue depends on your circumstances and whether both parties agree to the terms.

For international couples, divorce proceedings may involve complex issues such as cross-border asset division, child custody across jurisdictions, and recognition of Thai court judgments abroad.

Uncontested Divorce (Mutual Agreement)

An uncontested divorce is the fastest and most cost-effective option when both spouses agree to the divorce and its terms.

Requirements

  • Mutual agreement by both spouses to divorce
  • Agreement on child custody and support (if applicable)
  • Agreement on asset and debt division
  • Signed divorce agreement by both parties
  • Witness signatures (typically two witnesses)

Process

Both parties appear together at the District Office (Amphur) with their signed divorce agreement and witnesses. The divorce is registered on the same day, and a Divorce Certificate is issued.

Contested Divorce (Court Proceedings)

A contested divorce occurs when one spouse files for divorce without the other's agreement, or when the parties cannot agree on the terms. This requires court proceedings.

Legal Grounds for Divorce

Thai law recognizes the following grounds for divorce:

  • Adultery - Proof of infidelity by the other spouse
  • Desertion - Abandonment for more than one year
  • Cruelty - Physical or mental abuse
  • Serious Misconduct - Behavior damaging to the marriage
  • Long-term Separation - Living apart for more than 3 years

Asset Division & Settlement

Thai law distinguishes between personal property (owned before marriage or acquired individually) and marital property (acquired during the marriage).

Key Principles

  • Personal Property: Remains with the owner and is not divided in divorce
  • Marital Property: Generally divided equally between spouses
  • Debt Liability: Marital debts are typically divided equally
  • Property Documentation: Clear documentation of ownership is essential

Child Custody & Support

In divorce proceedings involving children, the court prioritizes the best interests of the child when determining custody and support arrangements.

Custody Arrangements

The court may award:

  • Sole custody to one parent
  • Joint custody with shared decision-making
  • Visitation rights for the non-custodial parent
  • Child support obligations

Special Considerations for International Couples

Jurisdiction: Thai courts have jurisdiction if one spouse is Thai or resides in Thailand. Court judgments may need recognition in your home country.

Cross-border Assets: Assets located outside Thailand may require separate legal proceedings in those jurisdictions.

Child Custody Across Borders: International child custody matters may involve Hague Convention considerations and enforcement in multiple countries.

Language & Translation: All court documents must be in Thai or professionally translated, adding time and cost to proceedings.
